JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prayer for bail of the petitioner was twice rejected by this Court but submission on behalf of the petitioner is that petitioner is in jail custody since 23.01. 2014 and having similar allegation co-accused Uttam Singh @ Amit Kumar Singh as well as Kaushar @ Md. Kaushar have already been granted privilege of bail. It is further submitted that up till now only four witnesses could be examined and there is no possibility of conclusion of trial of the petitioner in near future.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional
Patna High Court Cr.Misc. No.30860 of 2016 (2) dt.09-08-2016 2/2 District Judge-V, Katihar in connection with Session trial no. 76 of 2015 arising out of Pranpur P.S.Case No. 11 of 2014 , subject to condition that petitioner shall attend the trial court on each and every date for the period of six months or till conclusion of his trial which ever is earlier and, if he fails, to do so on two consecutive dates without any reasonable cause, the trial court shall be at liberty to cancel the bail bonds of the petitioner after due and proper inquiry.
