The petitioner seeks bail in Kasba P.S. Case No. 24 of 2016, registered for the offences punishable under Sections 302, 201 and 120(B) of the Indian Penal Code.
The police lodged FIR against unknown after receiving dead body of the deceased. Later on, the deceased was identified as Md. Hasibur Rahman. During course of the investigation, one Sakur Alam was apprehended and he is said to have confessed his guilt. He disclosed that he along with others killed Hasibur Rahman and thrown his dead body in a maize field. It is further disclosed that the deceased had gone along with father of Sakur Alam for taking money for business of Bidi.
It is submitted that there is no material against the
Patna High Court Cr.Misc. No.34784 of 2016 (3) dt.08-11-2016 2/2 petitioner. Of course, the motorcycle and other articles of the deceased were recovered from different places. The petitioner is father of co-accused Sakur Alam and that is why the petitioner has falsely been implicated in the case.
Learned Additional P.P. did not dispute the fact. Considering the facts aforesaid and the fact that Md. Sakur Alam did not disclose the name of the petitioner as killer of the deceased, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Vth, Purnea in connection with Kasba P.S.
