JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 29-03-2019 This appeal is for grant of pre-arrest bail to the appellant against the order dated 29.1.2019 passed by Special Judge, SC/ST Act, Patna, in A.B.P. No. 656 of 2019 filed by the appellant, by which learned Special Judge has rejected prayer for pre-arrest bail of the appellant, who has been made accused in Bakhtiyarpur P.S.Case No. 580 of 2018, arising out of Special Case No. 634 of 2018, registered under Sections 323, 341, 379 of the Indian Penal Code and Section 3(i-r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Allegation against the appellant is of assaulting the informant and also abusing him by caste name and also snatching of Rs.70,000/- from him and FIR disclosed that during Panchayat election the appellant had knocked the informant from his motorcycle, due to which his left leg was fractured and for his treatment the appellant had given him Rs.30,000/- and when the amount was demanded the occurrence took place.
Patna High Court CR. APP (SJ) No.1144 of 2019 dt.29-03-2019 2/2 Submission of learned counsel for the appellant is that the whole allegation is false and concocted and there is no injury on the person of the informant.
Heard learned Special P.P., who has opposed the prayer for anticipatory bail.
Having heard both sides and in the facts and circumstances, this appeal is disposed of with a direction to the appellant to surrender before the court below and make prayer for regular bail, which shall be considered on the basis of materials available on record and, if possible, to be disposed of on the same day.
