JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Barauni Refinery P.S. Case No.61 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution story is that while the informant after withdrawing Rs.50,000/- was returning to his house along with her mother, two miscreants on the motorcycle came and snatched Rs.50,000/-, mobile and pass book. Petitioner is not named in the F.I.R. but later on, his name transpires in the confessional statement of co-accused Ritesh Kumar and the petitioner is also involved in five other cases. Submission of the learned counsel for the petitioner is that as a matter of fact, he was having two cases and after arrest in this case, he has been remanded in three other cases and nothing is against the petitioner except the confessional

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni Refinery P.S. Case No.61 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
