05.08.2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offences under Section 379 of the Indian Penal Code and later on Section 411 IPC was added.

The stolen mobile is said to have been recovered from conscious possession of the petitioner but submission on behalf of petitioner is that the aforesaid mobile was found by the petitioner in abandoned condition near railway line and he innocently took up the aforesaid mobile and used inserting his SIM and the aforesaid act of the petitioner landed him in jail. The petitioner does not have any criminal antecedents and is languishing in jail custody since 31.05.2016. Considering the aforesaid facts and

Patna High Court Cr.Misc. No.30581 of 2016 (2) dt.05-08-2016 circumstances, let the Petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Khagaria in connection with Naugachhia Rail P.S. Case No. 08 of 2016 (G.R. No. 26 of 2016).
