Earlier the prayer for anticipatory bail of the petitioner was dismissed vide order dated 08.02.2019 passed in Cr. Misc. No. 7650 of 2019 and allegation against the petitioner is of recovery of 1785 litres of liquor from the field of the petitioner. Submission of learned counsel for the petitioner is that this second anticipatory bail petition has been filed on the ground that some new facts has emerged as the land from which the recovery was made does not belong to the petitioner rather the same is Government land and petitioner has falsely been roped in the case.

Having heard both sides, considering the fact that the

Patna High Court CR. MISC. No.18594 of 2019(2) dt.04-04-2019 2/2 prayer for anticipatory bail of the petitioner has already been refused and petitioner was directed to surrender before the court below and make prayer for regular bail, as such, I am not inclined to grant the privilege of anticipatory bail. However, the petitioner is directed to surrender before the court below within a period of six weeks and pray for regular bail, which will be disposed of by the court below on the basis of submission of learned counsel for the petitioner.

This application is accordingly dismissed.
