====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-09-2022 Heard learned counsel for the parties.

The petitioners apprehend their arrest in a case registered for the offence under Section 302 of the Indian Penal Code.

It is submitted on behalf of petitioners that petitioner no. 1 is brother-in-law of the deceased and petitioners no. 2 & 3 are sons of petitioner no. 1 and they have been falsely implicated only on suspicion. During course of investigation, daughter of the deceased has stated that altercation took place between the deceased and co-accused Rajesh Mahaldar and thereafter, at about 7:00 PM, the condition of her mother

Patna High Court CR. MISC. No.20428 of 2022(2) dt.01-09-2022 2/2 deteriorated and she was admitted in hospital, but she died. During investigation, no evidence has come to show complicity of petitioners in the aforesaid crime. Similarly situated coaccused Rajesh Mahaldar has already been granted anticipatory bail by this Court, vide order dated 27.04.2022 passed in Cr.Misc. No. 47694 of 2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Amour P.S. Case No. 59 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
