The petitioner apprehends his arrest in connection with Manpur P.S. Case No.42/15 registered under Section 7 of the Essential Commodities Act.
The accusation is of carrying of 240 litres petrol on five motor cycles.
Learned counsel for the petitioner submits that neither the petitioner was apprehended at the spot nor any thing was recovered from the conscious possession of the petitioner.Further submission is that no offence is made out under the provision of the E.C. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bettia, West Champaran, in connection with Manpur P.S.Case No.42/15, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
