JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 625(c) of 2018 in which cognizance has been taken under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act. Allegation against the petitioner is of demanding Rs.70,000/- for purchase of a motorcycle and for non-fulfilment of demand the complainant was subjected to torture and ousted from the house.

Submission of learned counsel for the petitioner is that the allegations are false and concocted and he is still ready to keep the complainant with him with dignity and care. Heard learned APP and learned counsel for the

Patna High Court CR. MISC. No.18525 of 2019(4) dt.18-06-2019 2/2 complainant, who have submitted that if she is allowed to live with dignity and care she is ready to live with the petitioner. In view of above submission, let petitioner appear before the court below on 3.7.2019 and on that day the complainant shall also remain present in court and on filing of a petition by the petitioner that he is ready to keep the complainant with him with dignity and care and also ready to take her from the court itself to his house, he will be granted provisional bail for a period of six months and during that period the court below shall watch the conduct of both the parties by calling them in every month in court and once the court is satisfied with their conduct, specially the petitioner, his bail bond shall be confirmed, otherwise the court below is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner. With the above observation, this application is disposed of.
