The petitioner apprehends his arrest in a case registered for the offence under Section 406 of the Indian Penal Code.
As per complaint case, the complainant deposited Rs. 1,37,000/- into the account of this petitioner for supply of certain machines, but the petitioner did not supply the same. It is submitted on behalf of petitioner that petitioner is proprietor of M/s Ayush Trading Agency and is engaged in the business of milk products, eatable oils, glass-ware etc. and complainant purchased goods from him amounting to Rs. 1,84,600/- alongwith transportation charge of Rs. 1520/-, total comes to Rs. 1,86,120/- and complainant paid Rs. 1,37,000/- and when the petitioner demanded rest dues amount from the
Patna High Court CR. MISC. No.20618 of 2022(2) dt.01-09-2022 2/2 complainant, the instant complaint case has been lodged against petitioner only with a view to harass and put pressure on him (petitioner).
However, learned A.P.P. for the State opposed the bail petition and submitted that complaint was lodged in the year 2017 and petitioner has moved this application after lapse of five years and there is no explanation in the entire petition as to why he did not move earlier before the court for grant of bail. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
