22-11-2016 Heard Sri Sanjay Kumar @ S.K., learned counsel for the petitioner and Sri R.B.Roy Raman, learned Addl. Public Prosecutor.
The petitioner, who is in custody in Sessions Trial No. 737 of 2009, arising out of Ahiyapur P.S. Case No. 98 of 2001 registered for offence under Sections 364, 120(B), 34 of the Indian Penal Code, has prayed for grant of bail.
Earlier, a report was called for from the court below regarding the present stage of the case, including statement of the victim recorded under Section 164 of the Cr.P.C., which has been received. The report suggests that in this case, charge has already been framed on 30-05-2016 and thereafter, summon has been directed to be issued.
Patna High Court Cr.Misc. No.30968 of 2016 (6) dt.22-11-2016 2/2 Keeping in view the seriousness of the accusation and the facts disclosed in the statement of victim recorded under Section 164 of the Cr.P.C., I do not find any ground to extend the privilege of bail.
The petition stands dismissed.
The learned court below is required to take step for early disposal of the case.
