JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the brother of the husband of the informant is apprehending arrest in a case filed for the offences punishable under Sections 498A, 376/ 511/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is of torture for non-fulfillment of the dowry demand. It is alleged against the brother of the husband of the informant to have made an attempt to outrage the modesty of the informant. Though it is also alleged that father-in-law made attempt to ravish her.
It is submitted by learned counsel for the petitioner that there is no specific overt-act alleged against the petitioner in the First Information Report.
Considering the thrust of accusation against the husband of the informant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender
Patna High Court Cr.Misc. No.35115 of 2015 (2) dt.24-08-2015 2/2 before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaiumr (Bhabhua) in connection with Durgawati P.S. Case No.81 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
