The petitioner is in custody in connection with Brahampur P.S. Case No. 18 of 2019 for the offence under 30 (a) of Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case total 2332.8 liters liquor was seized from the Pick up Van and Mahendra Logan Car respectively. Learned counsel for the petitioner submits that petitioner is only driver of the Pick Up Van and he is in custody since 23.01.2019.

Considering the fact that the petitioner has no criminal antecedent and he is remained in custody for more than 2 and 1⁄2

Patna High Court CR. MISC.
