The petitioner has expressed the hardship faced by him and has sought a lessor amount be directed to be paid at the time of furnishing bail bonds. It appears that under order dated 10.07.2015 the petitioner was directed to surrender within a period of five weeks and furnish the bail bonds. Along with the bail bonds, the petitioner was also required to deposit 15% of the misappropriated amount depicted in the FIR and the remaining misappropriated amount was directed to be deposited within 05 months whereafter the provisional bail was directed to be confirmed.

Having regard to the submissions made at the Bar and

Patna High Court Cr.Misc. No.35175 of 2015 (2) dt.09-09-2015 2/2 considering the interest of justice, this Court modifies the order dated 10.07.2015 to the effect that the petitioner shall surrender within three weeks from today and furnish the bail bonds for his release on provisional bail for a period of six months therefrom. At the time of furnishment of bail bonds the petitioner shall produce the receipt showing deposit of 10% of the misappropriated amount depicted in the FIR. The remaining 15% of the misappropriated amount shall be deposited by the petitioner within six months of his release on provisional bail in order to get the same confirmed as per the order dated 10.07.2015. The application is allowed in the aforesaid terms. The order dated 10.07.2015 is modified accordingly. (Kishore Kumar Mandal, J) HR/- U
