The petitioner is languishing in custody for the offences punishable under Section 304(B)/34 of the I.P.C. Petitioner is husband of the victim of dowry death. Petitioner is in custody since 23.08.2019.

In the past, prayer for bail was refused on 02.06.2020 with liberty to renew the prayer if the trial does not conclude within nine months.

The report of the trial Judge dated 17.08.2021 would reveal that charges have been framed on 25.09.2020, however, no prosecution witness has turned up till date. Considering the period already undergone by the petitioner and undertaking of the petitioner to fully cooperate

Patna High Court CR. MISC. No.35641 of 2021(3) dt.29-09-2021 2/2 with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No. 675 of 2019 arising out of Dalsinghsarai P.S. Case No. 70 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
