The petitioner seeks bail in Raghunathpur P.S. Case No. 52 of 2018, registered for the offence punishable under Sections 272, 273 and 308/34 of the Indian Penal Code and Sections 30(A), 38(A), 41(i) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner is correct in his submission that similarly circumstanced co-accused persons, namely, Umesh Yadav and Mukesh Kumar Yadav @ Mukesh Yadav have been granted regular bail by this Court by orders dated 23.07.2018 and 20.09.2018, passed in Cr. Misc. No. 44331 of 2018 and Cr. Misc. No. 57394 of 2018, respectively and one co-accused, namely, Subhash Kumar Yadav @

Patna High Court Cr.Misc. No.62113 of 2018(2) dt.08-10-2018 2/2 Subhash Yadav has been granted anticipatory bail by order dated 27.07.2018, passed in Cr. Misc. No. 45740 of 2018. Considering the above submissions, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge-2nd -cum-Special Judge, Excise, Siwan in Raghunathpur P.S.
