The petitioner seeks regular bail in connection with Darihat P.S.Case No.16 of 2017 dated 13.3.2017 registered for offences punishable under Sections 302, 201, 120(B),34 of the Indian Penal Code and Section 27 of the Arms Act.. Allegation as per FIR is that the dead body of the father of the informant was found lying in the field and he suspects that his gotia Jitesh Pandey and Sunil Pandey under conspiracy have killed the deceased and later on name of the petitioners transpired in this case.

Submission of the learned counsel for the petitioner is that name of the petitioner transpires only on suspicion on the statement of the wife of the deceased as the deceased was

He is in custody since 31.1.2019 and the persons who are named in the FIR have been granted bail by Co-ordinate Bench of this Court vide order dated 14.12.2017 passed in Cr. Misc. No.58068 of 2017, order dated 15.12.2017 passed in Cr. Misc. No.57978 of 2017 and order dated 25.2.2019 passed in Cr. Misc. No.11321 of 2019. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M Ist , Dehri On Sone, Rohtas in connection with Darihat P.S.Case No.16 of 2017. With the above direction, this application is allowed.
