JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-06-2020 Heard Mr. Jeetendra Narayan , learned counsel for the petitioner and Mr. Tarun Prasad Mandal, learned Additional Public Prosecutor appearing for the State through video conferencing.

The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 1117 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code, 1860. The allegation against the petitioner is that on the date of occurrence i.e on 12.09.2019 the informant was sleeping on her bed and at about 12.30 A.M. two persons entered into her house through the window and on the point of gun and knife they demanded the key of the main gate and when the informant resisted, they assaulted her and after opening the main gate

Patna High Court CR. MISC. No.18593 of 2020(2) dt.04-06-2020 2/3 about 9-10 persons entered into the house and broke open the Godrej and looted away Rs. 20,000/- and ornaments. It has further been alleged that one of the co- accused persons namely, Deepak Kumar Sahni was identified by the informant. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Learned counsel further submits that the name of the petitioner has transpired on the basis of confessional statement made by co-accused Deepak Kumar Sahni. Learned counsel further submits that the said Deepak Kr. Sahani @ Deepak Kumar Sahani @ Deepak Khesh has been granted bail by this Court in Cr. Misc. No. 11284 of 2020 on 1st June, 2020. Learned counsel further submits that petitioner has got no criminal antecedent and in the T.I.

parade the petitioner was not identified by the informant. He also submits that petitioner is in custody since 01.10.2019. Having regard to the submissions made by the parties and taking into consideration the fact that the person on whose confessional statement the name of the petitioner has come in this case has been granted bail by this Court and the petitioner has got no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be

Patna High Court CR. MISC. No.18593 of 2020(2) dt.04-06-2020 3/3 released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 1117 of 2019.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
