2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Sikrauli P.S. Case No. 132 of 2025 registered for the offences punishable under Sections 316(2), 318(4) and 69 of BNS and Section 3⁄4 of DP Act.
3. As per FIR the marriage of informant was finalized by her parent with petitioner after due discussion with his family. It is alleged that ring ceremony was organized, where Rs. 5 lakh was paid by the father of the informant to the family of the petitioner and also subsequently Rs. 80,000/- was paid for different household items. Thereafter Rs. 4 lakh was also paid as financial help
Patna High Court CR. MISC. No.19147 of 2026(2) dt.31-03-2026 2/3 for construction of house. FIR also suggest that after ring ceremony informant who is 23 years old was talking regularly with petitioner and also entered into physical relationship.

It is submitted by learned counsel appearing on behalf of the petitioner that the factual aspect of this case nowhere suggest that on the false promise of marriage physical relationship was established. It is submitted that marriage was fixed between two families and therefore the consent was not obtained with any deceitful means as to attract offence punishable under Section 69 of BNS. It is submitted that as certain money was paid by father of the informant to father of the petitioner, which was not returned to him, petitioner was implicated falsely with present case who is otherwise man of clean antecedent.
5. Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail submitted that allegation is specifically available against petitioner.
6. In view of aforesaid factual submission and by taking note of fact as prima-facie marriage was negotiated

No.19147 of 2026(2) dt.31-03-2026 3/3 between the family members of informant and petitioner, where prima-facie it nowhere appears that sexual relationship established by deceitful means like false promise of marriage by petitioner, accordingly petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Addl. Session Judge I cum Spl. Judge SC/ST Act, Buxar /concerned Court, where the case is pending in connection with Sikrauli P.S. Case No. 132 of 2025, subject to the conditions as laid down under Section 482(2) of BNSS. (Chandra Shekhar Jha, J) Sudha/- U T
