JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code in which charge-sheet came to be submitted under Sections 406 and 409 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 16.09.2021, is a person with clean antecedent and the informant alleges that petitioner being Chairman of the Ward Kriyanvayan Prabandhan Samiti received Rs. 6 lakhs from the Government for execution of work under Gramin Peyjal Yojana but work to the tune of only Rs. 1,52,736/- was done and rest of the amount was

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that no opportunity was given to the petitioner to explain his side of the case or else the present FIR would not have been instituted, it is also submitted that even the work now has been completed.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mahindwara P.S. Case No. 55 of 2021.
