JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 447, 341, 323, 324, 307, 504 and 379/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits, referring to the First Information Report, that it is alleged against the petitioner that he gave a Farsa blow causing injury on the head of the brother of the informant. He further submitted that upon medical examination, the injury on the head of the brother of the informant has been found to have been caused by hard and blunt substance which falsifies the allegations made in the First Information Report. In view of the facts and circumstances coupled with

No.43130 of 2014 (2) dt.20-03-2015 2/2 the fact that petitioner has no criminal antecedent, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of Marhaurah P.S. Case No. 148 of 2014, in connection with Chief Judicial Magistrate, Saran at Chapra, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
