JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 At the very outset, learned counsel for the petitioners has submitted that since the petitioner no. 1, namely, Maksudan Ram, has already been taken into custody, he does not wish to press the application for anticipatory bail of petitioner no. 1. As regards petitioner no. 2 and 3, they are apprehending their arrest in connection with Bagaha (Patkhauli) P.S. Case No. 351/16 registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 348, 354, 427, 379 and 504 of the Indian Penal Code.

It has been submitted on behalf of the petitioners no. 2 and 3 that only general and omnibus allegation has been levelled against them and there is case and counter case between the parties and the allegation against petitioner no. 2 is that he assaulted the father of the informant, however no injury was caused to him and the allegation against petitioner no. 3 is that he assaulted

Patna High Court Cr.Misc. No.4313 of 2017 (2) dt.13-02-2017 2/2 informant's sister with dab, however the injuries caused to her was simple in nature.

Having heard both sides, considering the fact that there is case and counter case between the parties and no specific overt act has been attributed to these petitioners, let the petitioner nos. 2 and 3, namely, Ashok Ram and Pintu Ram, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of like amount each to the satisfaction learned ACJM, Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No. 351 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

This is further subject to condition that the petitioners will cooperate in the investigation of case and make themselves present before the police as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
