As observed by the Apex Court in Amit Kapoor vs. Ramesh Chander & Anr. reported in (2012) 9 SCC 460 wherein at para-17, it has been observed that the time of framing of charge the mode consideration of the materials happens to be weaker than prima facie case, in the aforesaid background the learned counsel for the petitioner seeks withdrawal of instant petition.
