The petitioner apprehends his arrest in Dumraon P.S. Case No. 116 of 2017 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioner along with Dayashankar Pandey, Harishankar Pandey and Awadhesh Pandey came near his newly constructed house and assaulted the informant and his brother Ranu Pandey. Awadhesh Paney is alleged to have assaulted the informant with Dab which hit on his shoulder and the informant also got injury on his teeth. Harishankar Pandey assaulted the brother of the informant. Learned counsel for the petitioner submits that there is a land dispute between the parties from before. The informant
Patna High Court Cr.Misc. No.34741 of 2017 (2) dt.10-08-2017 and his brother got simple injuries. There is no specific allegation of assault against the petitioner.
Considering the facts aforesaid and the fact that there is no specific allegation against the petitioner, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in Dumraon P.S. Case No. 116 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) KKSINHA/- U T
