Dwivedi, appearing on behalf of the petitioner submitted that in view of the Division Bench judgment of this Court reported in 2010 (2) PLJR 954( Durga Devi Vs. Vijay Kumar Poddar) and the decision of the Hon'ble Supreme Court reported in (2004) 9 SCC 512 (Liverpool & London S.P. & I Association Ltd. Vs. M.V.Sea Success I), the petitioner has got revisional forum under the Code of Civil Procedure and therefore, he seeks permission that the petitioner may be permitted to convert this writ application to civil revision application under Section 115 CPC. The learned counsel, Mr. J.S. Arora conceded to this position of law.
In view of the submissions of the learned counsels for the parties, the petitioner is permitted to convert this writ application to revision application under Section 115 CPC within three weeks. Sanjeev/- (Mungeshwar Sahoo, J) U
