JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 8.3.2016 for the offences punishable under Section 302/34 of the Indian Penal Code.

Admittedly none has seen the actual killing of the deceased. It is only stated that the deceased had left home along with the petitioner and some others. Moreover, after investigation, Police found the case untrue in respect of the petitioner and, accordingly, final form was submitted against him. Learned counsel for the petitioner submits that having more or less similar allegations, the co-accused have been granted bail by this Court which is apparent from Annexure 2 series.
