20-09-2018 Heard Sri Krishna Deo Raj, learned counsel for the petitioner and Sri Shailendra Kumar Singh, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Warisaliganj P.S. Case No. 20 of 2015 registered for offence under Sections 467, 468, 471, 472, 414, 419, 420/120B of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.

At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. He further submits that petitioner has been arrayed as accused only on the basis of confessional statement of co-accused, otherwise, there is no other material to connect the petitioner in the present case. Patna High Court Cr.Misc. No.58695 of 2018(2) dt.20-09-2018 2/2 - 2 series to the petition to show that at least five accused persons have been extended the privilege of anticipatory bail by this Court. Two accused namely Tuntun @ Dhirendra Kumar and Gautam Singh were extended the privilege of anticipatory bail on 24-11-2015, vide Cr. Misc. No. 53582 of 2015 and other three accused namely Amit @ Amit Kumar, Chhote Lal @ Chhotelal Singh and Ramesh Singh were granted anticipatory bail on 23-05-2016, vide Cr.Misc. No. 23045 of 2016. Considering the nature of accusation as well as the fact that other co-accused, in similar circumstances, have been granted anticipatory bail, there is no reason to refuse the same relief to the petitioner.

Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Guddu Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Nawada in connection with Warisaliganj P.S. Case No. 20 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) anay U T
