JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-457, 380 of the Indian Penal Code.

Petitioner is not named but he was arrested in connection with Bajpatti P.S. Case No. 12 of 2016 and made his confessional statement accepting his involvement in the abovesaid case as well as present case also. The stolen idols were recovered from a pond situated near a temple. Learned counsel for the petitioner submits that the aforesaid recovery has not been made on the basis of confessional statement of petitioner and as a matter of fact, he has been remanded in this case from Bajpatti P.S. Case No. 12 of 2016.

No.36908 of 2016 (2) dt.05-09-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sursand P.S. Case No. 137 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi.
