JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-10-2018 The petitioner seeks regular bail in connection with Hajipur Industrial Area P.S. Case No. 92 of 2018, registered for offences punishable under Sections 399, 402, 34, 41 2, 414 of Indian Penal Code and Section 25(1-b), 26 and 35 of the Arms Act.
Prosecution case is that police on information that some persons have assembled for committing robbery raided the place and arrested the accused persons including petitioner and from the possession of petitioner one loaded country made pistol has been recovered. Apart from that he is an accused in one more case. It has been submitted on behalf of the petitioner that he is he has falsely been made accused and in fact nothing has been recovered from his possession and he has been in judicial custody
Patna High Court Cr.Misc. No.60344 of 2018 (2) dt.06-10-2018 since 29.05.2018 and he has also been made accused in one more case after arrest in this case.
Heard learned A.P.P. also.
Having heard both sides, considering the fact and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner to his own satisfaction, once petitioner completes six months in judicial custody.
