The present petition has been preferred for quashing of the order dated 29.05.2015 passed by the learned 1st Additional Sessions Judge, East Champaran, Motihari in Sessions Trial No. 591 of 2014 arising out of Ghorasahan (Jitna) P.S. Case No. 146 of 2013 registered under Sections 363, 366A, 120 and 34 of the Indian Penal Code, 1860 and subsequently Section 212 of the Indian Penal Code was added by which discharge filed on behalf of the petitioner has been rejected. As per the prosecution story, the allegation is that the informant daughter, Rehana Khatoon was out to fetch water when a 'Bolero' vehicle came and named accused persons forcibly took her away. Later, the informant side went to the house of the accused persons where it is alleged that the family members assaulted them. Accordingly, the FIR was lodged. It was the case of the petitioner that the girl married Sanjay Kumar.

In the aforesaid circumstances when on earlier occasion the matter was taken, the learned counsel for the petitioner had taken pass over with averment that the victim girl will be produced before the Court.

Today when the matter was called out, once again prayer for pass over has been made.

Considering the fact that the petitioner do not have any interest in the case, the petition stands dismissed. (Rajiv Roy, J) Jagdish/Neha/- U T
