The petitioner seeks bail in Konch P.S. case No. 224 of 2013 registered under Section 323, 324, 427 and other Sections of the Indian Penal Code, Section 27 of Arms Act, Section 3⁄4 of Explosive Substance Act and under Section 17 of C.L.A. Act. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The name of petitioner figured in the case in the confessional statement of co-accused Subedar Mistry. The informant alleged that extremists came and set on fire a bolero jeep and also exploded bomb and fled away. It is submitted that save and except confessional statement of coaccused there is no tangible material against the petitioner. Similarly situated other accused persons, namely, Anil Yadav @
Patna High Court Cr.Misc. No.58558 of 2018 (2) dt.20-09-2018 2/2 Rajendra Yadav and Nand Ram have already been granted bail. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is in custody since 18.04.2018, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Konch P.S. case No. 224 of 2013.
