The petitioner seeks regular bail in connection with Wazirganj P.S. Case No.50 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code.

It is alleged that on 15.02.2016 at about 8:00 p.m. this petitioner and other co-accused persons armed with deadly weapons intercepted the informant and fired with rifle with intent to kill him and caused firearm injury on the right leg of the informant.

It has been submitted that on the occasion of Sarswati Pooja such occurrence took place between two groups for which

Patna High Court Cr.Misc. No.58867 of 2018 (2) dt.08-10-2018 a counter case bearing Wazirganj P.S. Case No.51 of 2016 was also registered. The allegation of assault is omnibus against this petitioner. Both parties are residents of same locality and the matter has been compromised between the parties. He is in custody since 11.06.2018 having clean antecedent and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned A.C.J.M.-I, Gaya in connection with Wazirganj P.S. Case No.50 of 2016.
