Petitioner is seeking anticipatory bail in connection with Bettiah Town P.S. Case No. 54 of 2018 registered for the offences punishable under Sections 356 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Learned counsel submits that the name of the petitioner has transpired in the confessional statement of co-accused Golu Kumar, who is on inimical term with the petitioner and except that there is nothing to connect this petitioner with the present case. It is submitted that nothing incriminating has been recovered from the possession of this

Considering the facts and circumstances of the case wherein the submission is that nothing incriminating has been recovered from the possession of this petitioner and that the name of the petitioner has transpired in the confessional statement of co-accused Golu Kumar who is a co-villager and is on inimical term with the petitioner as also that the petitioner has got no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S.
