JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioners and the State. Learned Sr. Counsel appearing on behalf of the petitioners informs the Court that this application for anticipatory bail to the extent it relates to petitioner Nos. 1, 2 and 3, has become infructous, as they have been arrested during the pendency of the present application. Accordingly, this application with respect to petitioner Nos. 1, 2 and 3 is dismissed as having become infructuous.
So far as the petitioner No. 4 Pankaj Yadav @ pankaj Kumar Yadav is concerned, he presses this anticipatory bail
Patna High Court Cr.Misc. No.42003 of 2014 (3) dt.04-03-2015 2/2 application on his behalf, who is an accused in case registered for an offence punishable under Section 307, 379, 341, 323, 147, 148, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned Sr. Counsel has submitted that there is allegation against the petitioner Pankaj Yadav of carrying khanti and all the accused persons assaulting the informant. Referring to injury report learned Sr. Counsel has submitted that there is no injury by sharp cutting weapon on the person of the informant. He has submitted that the petitioner has no criminal antecedent. Considering the facts and circumstances as above, in case of arrest or surrender within a period of four weeks, let petitioner No. 4 be released on bail on furnishing bail bonds of Rs.
10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (M) P. S. Case No. 153/2014, subject to condition as laid down under Section 438(2) of Cr. P.C.
