Petitioner, who is in custody, seeks bail in connection with K. Hat P.S. Case No. 454 of 2016 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and under Section 27 of the Arms Act. Informant who is the uncle of the deceased has alleged that his nephew Aman Kumar Singh has been killed by unknown persons due to enmity.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Name of the petitioner has surfaced in this case only on the basis of confessional statement of other co-accused, Punkesh Kumar Singh and except

Patna High Court Cr.Misc. No.60871 of 2018(2) dt.05-10-2018 2/2 confession there is nothing against petitioner. It has been further submitted that similarly placed co-accused, namely, Aman Singh has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 28868 of 2017 vide order dated 20.07.2017. He is in custody since 13.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnia in connection with K. Hat P.S. Case No. 454 of 2016.
