Petitioners being father and brothers of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
The accusation is killing the daughter of the informant after about five years of marriage for non-fulfilment of dowry demand.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family. From perusal of the First Information Report, it appears that accusation of demand of dowry is against the husband of the victim.
Patna High Court Cr.Misc. No.35561 of 2015 (2) dt.20-08-2015 2/2 Considering the fact that thrust of accusation is against the husband of the victim, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 71 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
