Earlier the petitioner had moved before this Court and his application was permitted to be withdrawn, vide order dated 17.7.2018 passed in Cr. Misc. No.42719 of 2018 and thereafter the present application has been filed. The allegation against the petitioner is that a sex racket was detected in the hotel of the petitioner and the petitioner was made accused. Submission of the learned counsel for the petitioner is that nobody has named the petitioner and as he is owner of the hotel, in which the occurrence took place, as such he has been made accused and the other co-accused persons have been granted privilege of the anticipatory bail, vide order dated 5.4.2018 passed in Cr. Misc. No.15800 of 2018 by a Co-ordinate Bench of this Court and vide order date 25.6.2018 passed in Cr. Misc. No.19371
Patna High Court Cr.Misc. No.58124 of 2018 (2) dt.19-09-2018 2/2 of 2018 passed by this Court.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Bodh Gaya P.S.Case No.13 of 2018, with condition that he will cooperate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
