The petitioner is apprehending his arrest in connection with Hathouri P.S. Case No. 37 of 2018 for the offence registered under Sections 147, 149, 307, 323, 341, 504, 506 of the Indian Penal Code and later on 302 of the Indian Penal Code was added.
Learned counsel for the petitioner submits that there is no specific allegation against this petitioner and general and omnibus allegations have been leveled against all the accused persons and as such other co-accused persons have been extended the privilege of anticipatory bail vide order dated 18.09.2018 passed in Cr. Misc. No. 58355 of 2018. It is thus, submitted the petitioner may also be extended the same
Patna High Court CR. MISC. No.24353 of 2019(2) dt.12-07-2019 2/2 privilege as he has no specific role in the occurrence. Considering the aforesaid facts and circumstances of the case and that similarly situated co-accused persons has been granted anticipatory bail, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., IInd Rosera, Samastipur in connection with Hathouri P.S. Case No. 37 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
