Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Bounsi P.S. Case No. 17 of 2023 registered for the offence under Sections 25(1-b)a/26 of Arms Act.

The prosecution story in short is that on 20.01.2023 at about 02.40PM, the informant alongwith other police officials was on routine patrolling and they were checking the vehicles at Sanjhotari more they saw that one person was coming with very high speed towards them and when they tried

Patna High Court CR. MISC. No.20540 of 2023(2) dt.22-05-2023 2/3 to stop him, he tried to escape from there but the police nabbed him and on search, one country made pistol and two live cartridges were recovered from the possession of accused/petitioner.

Learned counsel for the petitioner submits that the petitioner is in custody since 21.01.2023 and the petitioner is quite innocent and has falsely been implicated in this case due to dirty village politics.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet Or after completing six months in custody whichever is later and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Banka /concerned Court below in connection with Bounsi P.S. Case No. 17 of 2023.
