This application has been filed for modification of order dated 01.12.2021 passed in Criminal Miscellaneous No. 7356 of 2020, by which the petitioner has been granted provisional bail subject to the condition that the petitioner is ready to keep his wife i.e. opposite party no.2 with full honour and dignity.

It has been jointly submitted by learned counsel for parties that both the parties i.e. petitioner and opposite party no.2 have married again with others.

Considering the aforesaid fact and also the law laid

Patna High Court CR. MISC. No.20608 of 2022(4) dt.29-06-2022 2/2 down by the Apex Court in the case of Arnesh Kumar vs. State of Bihar reported in (2014) 8 SCC 273, the provisional bail granted to the petitioner vide order dated 01.12.2021 passed in Criminal Miscellaneous No. 7356 of 2020 is hereby confirmed. This application is allowed with the modification as above.
