The petitioner apprehends his arrest in connection with Complaint Case No. 443C/2004 registered for the offences punishable under Sections 41 and 42 of the Indian Forest Act and Rule 5 of the Bihar Saw Mill Regulation Act. Learned counsel for the petitioner submits that during the course of raid at petitioner's premises which was conducted by the Forest Department, as per the seizure list, one wheel of saw mill and some logs of wood were recovered. It is further submitted that he was a valid license holder of saw mill since long time but after the direction of the Hon'ble Supreme Court, the said license was cancelled/not renewed. It was under such circumstances, one wheel of saw mill and some log of wood

Patna High Court Cr.Misc. No.43757 of 2014 (2) dt.16-04-2015 still existed at his premises.

Considering the aforesaid submissions and fact that petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Complaint Case No. 443C/2004 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. '
