JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-06-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). That an appropriate writ may be issued commanding upon the Respondents for removal of encroachment and maintenance and improvement of the Pokhar, Talab, Jalkar Aahar which was settled in the name of petitioner/Mantri of Matsyajivi Sahyog Samiti Ltd. Kudra for the settlement year 2023 to 2027. (ii). That an appropriate writ may be issued commanding upon the Respondents authority to take necessary steps to remove the encroachment by the anti-social elements over the area settled in the name of petitioner society.

(iii). That an appropriate writ may be issued

Patna High Court CWJC No.5117 of 2024(2) dt.20-06-2024 2/2 commanding upon the Respondent no.4 to direct to remove the encroachment upon the Pokhar, Jalkar, Talab, Aahar by which petitioner was in possession of 92 Jalkar, Talab Ahar but Pokhar Talab, Jalkar have been encroached by the antisocial elements." 2.

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Kudra, District-Kaimur at Bhabhua, for redressal of his aforesaid grievances, especially in light of the judgment dated 21.7.2023, passed in CWJC No. 9692 of 2015 (Ram Punit Choudhary vs. the State of Bihar & Ors.). Liberty, so sought, is granted.
