JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-10-2018 Heard the parties. The petitioners seek regular bail in connection with Mirganj P.S.Case No. 134 of 2018, registered or the offence under Section 302 and 34 of the Indian Penal Code. As per F.I.R., allegation against the petitioner is of assault to the son of the informant, causing his death. Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and this occurrence was taken place due to the removal of Maro of the marriage from the land of the petitioner but the post mortem report has not supported the injury, which is annexed as Annexure-3 of this petition and he is in custody since 24.05.2018. Heard learned A.P.P. opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to
Patna High Court Cr.Misc. No.60505 of 2018 (2) dt.06-10-2018 2/2 the petitioner at this stage. However, he may renew prayer for bail after examination of the informant before the Trial Court, who will consider the prayer for bail on the basis of material available on the record.
With the aforesaid observation, the instant petition is accordingly dismissed.
