JUSTICE RAKESH KUMAR ORAL ORDER 12-07-2016 Heard Sri Prabhat Kumar, learned counsel for the petitioner and Sri Nityanand Tiwary, learned A.P.P. The petitioner, who is in custody in connection with Noorsarai P.S. Case No. 89 of 2016 registered for the offence under section 307, 353 of the Indian Penal Code and Section 25(1-b)a/ 26 of the Arms Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated in the present case on an allegation of recovery of one loaded country made pistol. He submits that on perusal of the F.I.R. no offence under section 307 of the Indian Penal Code is made out.

No.26827 of 2016 (2) dt.12-07-2016 2/2 Be that as it may, considering the nature of accusation and the period of custody, let the petitioner Mishri Paswan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Nalanda, Biharsharif in connection with Noorsarai P.S. Case No. 89 of 2016.
