JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends her arrest in connection with Balthar P.S. Case No. 20 of 2016 for the offences punishable under sections 304 (B) and 201/34 of the I.P.C.

At the very out set, it is submitted on behalf of the petitioner that in this case after completing investigation the petitioner was not sent up for trial and the charge sheet was submitted only against Ash Narayan Patel and Dhanai Patel, vide Annexure-3, and further the informant after knowing the reality has filed petition in the learned court below showing innocence of the petitioner and others in this case, vide Annexure-2, and as such

Patna High Court Cr.Misc. No.2674 of 2017 (2) dt.25-01-2017 2/2 the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that after investigation the petitioner was not sent up for trial, but later on the Superintendent of Police directed to arrest the petitioner also. In the facts and circumstances as stated above, the petitioner, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. Sri N.P. Singh, J.M. 1st Class, Bettiah (West Champaran) in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
