JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend their arrest in connection with Ramgarh P.S. Case No. 238 of 2016 registered for the offence under Sections 341, 323, 324, 337, 307 and 504/34 of the Indian Penal Code.

The allegation against the petitioners is of assaulting the informant by means of Axe, Farsa and Rama with an intention to commit his murder.

Considering the fact that there is direct allegation of assault against the petitioner no.1 namely Nesar Ansari, therefore, his prayer for anticipatory bail in connection with Ramgarh P.S.

Patna High Court Cr.Misc. No.2265 of 2017 (3) dt.13-02-2017 Case No.238 of 2016 pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua is rejected. So far petitioner no.2 namely Hazarat Ansari is concerned, there is general and omnibus allegation against him. Therefore, in the event of arrest or surrender within a period of four weeks from today, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Ramgarh P.S. Case No. 238 of 2016, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
