2. Petitioner seeks regular bail in connection with Pothiya P.S. Case No. 158/ 2024 dated 29.06.2024 registered for the offence(s) punishable under Section(s) 341, 323, 325, 307 read with section 34 of the IPC.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is a 66 years old person, suffering from several diseases and there is no specific allegation against him and he and co-accused, Sunil Murmu are alleged to have assaulted at the head of the informant by means of iron rod and though, the informant sustained head injury but as per the order impugned, the concerned doctor opined that the injury may be grievous, so, there was no definite opinion by the doctor about

Patna High Court CR. MISC. No.20064 of 2025(5) dt.30-04-2025 2/2 the grievousness of the said injury. It is further submitted that the petitioner has been languishing in jail since 28.11.2024 having fair and clean antecedent and investigation against him has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the aforesaid submissions advanced by the petitioner's counsel coupled with the old age and custody period of the petitioner as well as completion of investigation against him, this court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Pothiya P.S. Case No. 158/ 2024 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
