Petitioner seeks bail in Doriganj P.S. Case No.204 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30 /38 of the Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that petitioner was not apprehended at the spot. The name of this petitioner has been taken by co-accused Jata Mahto, who was apprehended on the spot by the police. The police recovered 400 litres illicit liquor from his possession. He disclosed name of this petitioner. Petitioner is said to be in custody since 06.08.2018 having clean antecedents.

Patna High Court Cr.Misc. No.60587 of 2018 (2) dt.05-10-2018 2/2 In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 6th, Saran, in connection with Doriganj P.S. Case No.204 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
