The petitioner apprehends his arrest in Akbarpur P.S. case No. 181 of 2016 under Section 467, 468, 419, 420/34 of the Indian Penal Code.

The informant, Block Development Officer, alleged that the petitioner and Mukhiya committed irregularity in purchasing solar lights and thereby they misappropriated Rs. 94,772/-.

The learned counsel for the petitioner submits that petitioner was Panchayat Secretary of Gram Panchayat, Barail in the year, 2007. From Annexure-2, it would appear that Kunti Devi, Mukhiya of Barail Gram Panchayat, made specific order for purchasing solar lights at the cost of Rs. 46050/- from M/s Laxmi

Patna High Court Cr.Misc. No.4517 of 2017 (5) dt.22-05-2017 2/2 Sales Corporation, Roh, Nawada and petitioner simply obeyed the orders of the Mukhiya. The petitioner was not the part of the decision making body of the Gram Panchayat.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Nawada in Akbarpur P.S. Case No. 181 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
