JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2015 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant. The name of the petitioners suggested by one Punam Devi, as she saw going the victim in the company of the petitioners and others at auto stand.

It is submitted by learned counsel for the petitioners that the victim and one Raja Kumar, sworn separate affidavit on 09.05.2015 to the effect that they have performed marriage on 09.05.2015 and, thereafter, the present case has been lodged on

Patna High Court Cr.Misc. No.35262 of 2015 (2) dt.20-08-2015 2/2 17.05.2015. He further submits that the petitioners are agnate of the informant and between the parties Title Suit No. 313 of 201314 is also pending. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the lodging of the case much after marriage of the victim with Raja Kumar, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur Vaishali in connection with Bidupur P.S. Case No.212 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
